Terms of Service

1. General Information

1.1 These Terms of Service (the "Terms") govern the use of the ByzzPath online platform and the training materials available on the platform (hereinafter referred to as "the Platform"). The Platform is operated by BusinessPath (hereinafter referred to as "the Company"), located in Poland, 02-479 Warszawa, which is in the process of being officially established and registered. The company is currently undergoing the registration process in Poland and as such, certain formalities may be in progress. However, the Platform is fully operational and accessible to users.

1.2 By using the ByzzPath platform, the User agrees to be bound by these Terms.

2. Acceptance of the Terms

2.1 The User accepts these Terms by registering an account. The registration signifies acceptance of these Terms, without the need to sign a separate document.

3. Access to the Platform

3.1 The Company provides the User with access to the ByzzPath platform and the materials available on it, according to the conditions set forth in these Terms.

3.2 Access to the Platform is granted upon payment of the Membership Plan, Section 9.

4. License and Copyrights

4.1 The Company grants the User a non-exclusive, non-transferable, non-sublicensable right to use the ByzzPath platform and the training materials available on the platform ("Membership Plan") for the duration of the subscription, in accordance with the terms of these Terms. Materials subject to the Creative Commons Attribution-ShareAlike 3.0 Unported (CC BY SA 3.0) license, or other if applicable, are not subject to the terms of these Terms.

4.2 The Membership Plan granted to the User includes the right to:

• Access the ByzzPath platform and use the training materials on the devices owned by the User.
• Download materials and use them for educational purposes (meaning the use of materials exclusively in the context of self-learning, personal development), with proper attribution for materials under the CC BY SA 3.0 license or other if applicable.

4.3 The User does not have the right to:

• Use materials for commercial purposes (unless the materials are subject to the CC BY SA 3.0 license, or other, which allows such use).
• Transfer the Membership Plan to third parties.
• Use the platform and materials in a way that could disrupt its operation or violate the terms set by the Company.

4.4 The Membership Plan expires in the event of termination of the Terms or expiration of the subscription. Access to the ByzzPath platform will be blocked for the User.

5. Subscription and Membership Plan

5.1 The User can choose one of three available Membership Plans with an annual subscription (details provided on the web page www.byzzpath.com):

• Founder: Access to modules: Pre-seed
• Owner: Access to modules: Pre-seed, Seed
• Leader: Access to modules: Pre-seed, Seed, Early Stage (A), Stage B+

5.2 The choice of Membership Plan is made by the User at the purchase stage.

5.3 The purchase process is handled by Merchant, and the process and terms of conditions are described in Section 9

5.4 Payment for the subscription is made before starting to use the platform. Without confirmation of payment by the Merchant, the Membership Plan will not be granted. The subscription fee is provided at the time of purchase and is available during the checkout process. The User agrees to the financial terms provided in the offer. The payment amount may include current promotions.

5.5 The User has the right to change their chosen membership plan during the subscription period, but they are not entitled to a refund for the unused portion of the previous plan. The change in the membership plan will take effect on the day of the new purchase, and the new plan will apply until the end of the current subscription period. A detailed description of the available membership plans is available on the Platform’s website.

5.6 Granting access to the platform after payment confirmation may take up to 24 hours.

6. Termination of the Terms

6.1 Termination by the Company: The Company has the right to terminate the Terms in the following cases:

• Non-renewal of subscription. The User will be notified via email.
• Changes in the Company’s situation preventing continued provision of services. The User will be notified via email.

6.2 Refunds Upon Termination by the Company:

• After receiving information about the termination of the services by the Company, the User is required to provide their bank account details within 31 days for the refund to be issued.
• The refund will be made to the User’s bank account within 14 business days.
• The amount refunded to the User will be proportional to the unused subscription period, with the amount rounded up to the nearest full month in favor of the User.

6.3 Access to Materials after Termination: After termination of the Terms, the User loses the right to use the materials available on the ByzzPath platform, except for materials licensed under external rights.

7. Company’s Liability

The Company is not liable for technical issues that may prevent access unless arising from its fault. The Company reserves the right to modify materials, expand them, and add new features to benefit the User.

8. Data Protection

8.1 The Company processes the User’s personal data in accordance with applicable data protection laws. Details are provided in the Privacy Policy available on the Company’s website.

8.2 Users are prohibited from storing personal information on the platform, except for registration information.

9. Merchant of Record

9.1 The Company utilizes Merchant of record LemonSqueezy to handle sales. By purchasing the Membership Plan, the User agrees to the LemonSqueezy Buyer Terms: https://www.lemonsqueezy.com/buyer-terms

10. Final Provisions

10.1 Amendments: Amendments to these Terms will be communicated via email. The User agrees to be bound by the changes upon notification unless they inform the Company otherwise.

10.2 Dispute Resolution: In case of disputes, the parties will first attempt amicable resolution. If not possible, disputes will be submitted to the court competent for the Company’s registered office.

10.3 Communication: All communication regarding these Terms will be conducted through the email address provided by the User during registration.

10.4 Governing Law: These Terms are governed by Polish law.
